User Profile: We collect data when users create or change their Civilized Cycles accounts. This may include name, email, phone number, login and password, address, profile picture, payment information or bank details, official identity documents, date of birth, signature and Photograph. This data also includes vehicle or insurance information for partner drivers and delivery partners and user settings. We may use the photos submitted by partner drivers and/or delivery partners to confirm their identities, for example through facial recognition technologies. For more information, see the section entitled “How we use your personal data”.

Demographic Data: We may collect demographic data about users, including through user surveys. In some countries, we also receive demographic data about users from third parties.

User Content: We collect information that users submit when they contact Civilized Cycles' customer support, provide ratings or praise to other users or partner restaurants, or otherwise contact Civilized Cycles. This may include comments, photos or other records collected by users.

2. Data created while using our services. That includes:

Location data: When activated by the user, the feature allows us to collect accurate or approximate location data from the device, Civilized Cycles collects this data when the Civilized Cycles app is running in the foreground (app open and on screen) or in the background (app open but not on screen) on their device.

Transaction Information: We collect transaction information relating to the use of our services, including the type of service requested or provided, delivery information, the date and time the service was provided, the amount billed and the method of payment. Also, if someone uses your promotional code, we may associate your name with that person.

Usage data: We collect data about users' interaction with our services. This includes access dates and times, app features or pages viewed, app issues and other system activity, browser type and third-party websites or services used prior to interacting with our services. In some cases, we may do this collection through cookies, pixels, tags and similar technologies that create and maintain unique identifiers. Device Data: We may collect information about devices used to access our services, including hardware models, device IP address, operating systems and versions, software, preferred languages, device unique identifiers, advertising identifiers, serial numbers, data device movement and mobile network data.

Civilized Cycles may share users' personal data if it believes it is required by applicable law, regulations, operating license or contract, legal process or governmental request, or in cases where disclosure is appropriate, for other reasons, due to concerns about the security or similar. This includes sharing personal data with law enforcement/legal authorities, public health officials and other government authorities, airports (if required by airport authorities as a condition of operating on airport premises), or other third parties as necessary to apply our Terms and Conditions, user agreements or other policies; to protect Civilized Cycles;s rights or property or the rights, safety or property of others; or in the event of a complaint or conflict regarding the use of our services. If you use someone else's credit card, we may be required by law to share your personal data with the owner, including travel or order information.

This also includes sharing personal data with associated third parties, or during negotiations for any merger, sale of company assets, consolidation or restructuring, financing or acquisition of all or part of our business by another company.

Civilized Cycles may share a user's personal data in ways other than those described in this notice, if we notify the user and he consents to the sharing.

Civilized Cycles retains user profile data, transactions and other personal data as long as the user maintains their Civilized Cycles account.

Civilized Cycles may retain some user data after receiving account deletion request if necessary, such as to comply with legal requirements.

Users can request deletion of their account at any time via the Settings and Privacy menus in the Civilized Cycles app or through the Civilized Cycles Help Center. Upon such request, Civilized Cycles will delete the data that it is not obligated to store for the purposes of regulations, taxes, insurance, legal disputes or other legal requirements. For example, Civilized Cycles will retain location, device and usage data for these purposes for at least 7 years. During this period, it may also use them for security, fraud prevention and detection, research and development purposes. In some circumstances, Civilized Cycles may not be able to delete a user account, for example, if there are outstanding amounts on the account or if there is a complaint or conflict that has not yet been resolved. Once this issue is resolved,

Civilized Cycles may also retain certain information if necessary for security and fraud prevention purposes. For example, if Civilized Cycles deactivates a user's account because of unsafe behavior or security-related incidents, it may retain certain information about that account to prevent that user from opening a new Civilized Cycles account in the future.

We collect and use personal data only when we have a legal basis for it. This includes processing personal data in order to provide the services and offer the requested resources, for the purposes of the legitimate interests of Civilized Cycles or third parties, to fulfill legal obligations or on the basis of consent.

B. For the purposes of the legitimate interests of Civilized Cycles and other parties

This includes using personal data to maintain and improve the security of our users. For example, we use personal data to prevent the use of our services by users who have engaged in inappropriate or dangerous behavior, such as storing banned user data to prevent them from using Civilized Cycles' apps.

This also includes purposes such as combating fraud; improving our services, direct marketing, research and development; and application of Sailing Terms and Conditions.

In addition, this includes using personal data to the extent necessary for the interests of others or the general public, such as when relating to lawsuits or loss reporting and to protect the rights and safety of others.

For example, Civilized Cycles is subject to laws and regulations in several countries and cities that require it to collect and store data about our users' travels and provide copies of such data to the government and other authorities. We collect and use personal data to comply with such laws.

Civilized Cycles may also share data with law enforcement/legal authorities regarding criminal acts or threats to public safety or requests from third parties pursuant to legal proceedings.

Civilized Cycles may collect and use personal data based on the user's consent. For example, we collect personal data through voluntary surveys. Responses to these surveys are collected with your consent and will be deleted as soon as they are no longer necessary for the purpose for which they were collected.

Civilized Cycles also allows users to request access to their data or copies thereof, changes or updates to their accounts, deletion of their accounts or for Civilized Cycles to restrict its processing of user personal data.

A. Privacy Settings

The Sail app's settings menus for passengers give passengers the ability to configure or change location sharing preferences and preferences for receiving notifications from Civilized Cycles on the device. Information about these settings, the procedure for configuring or changing these settings, and the effect of disabling them are described below.

Location data

Civilized Cycles uses the location services of the user's device to make it easier to request a trip when he needs it. Location data helps us improve services such as departures, navigation and customer support.

Emergency data sharing (user)

Users who allow Civilized Cycles to collect location data from their device can also activate the “Emergency Data Sharing” feature, which shares data with police, fire and ambulance emergency services. This data includes the approximate location at the time the emergency call was placed;

Notices: account and travel updates

Civilized Cycles sends users notices of travel status and updates related to activity on their account. These notifications are required to use the Civilized Cycles app and cannot be disabled.

Users can allow Civilized Cycles to send push notifications about Civilized Cycles discounts and news.

B. Device Permissions

Most mobile device platforms (iOS, Android, etc.) have defined that certain types of device data cannot be accessed by apps without the owner's permission. These platforms use different ways to obtain these permissions. iOS devices notify users the first time Civilized Cycles' app requests permission to access certain types of data and give users the option to grant or refuse permission. Android devices notify users of the permissions the Civilized Cycles app asks for before you use it for the first time. By using the app, you grant such permission.

C. Not receiving marketing communications

Users can opt-out of receiving promotional emails from Civilized Cycles. Users may also follow the unsubscribe instructions contained in these messages to opt-out of receiving emails and other messages from Civilized Cycles. We may also send other types of messages, such as travel receipts or account information, to users who choose to opt-out of promotional communications.

D. User Data Requests

Civilized Cycles offers several ways for users to know and control their data and send questions and comments about their treatment by Civilized Cycles. To make a request.

Data Access: Users may ask for an explanation of the data we collect and how it is used.

Receipt of data: Users may request a copy of the data that Civilized Cycles collects from them with their consent or as necessary to provide our services.

We may occasionally change this notice. Using our services after a change constitutes consent to the amended notice, to the extent permitted by law.

If we make significant changes, we will notify users of them in advance through Civilized Cycles apps or other means such as email. We encourage users to periodically review this notice for the latest information about our privacy practices.

Warranty Terms

CIVILIZED CYCLES LIMITED WARRANTY

Civilized Cycles provides this limited warranty to all purchasers of The Civ to be free from defects in materials and workmanship for a period of 2 years from the original date of purchase, with the following exceptions:

General limitations:

This limited warranty does not cover ordinary wear and tear not the result of a defect in materials or workmanship.  Components and conditions not typically covered include but are not limited to:

Tires, and tubes.

Brake pads and brake rotors

Chain, chain sprockets, freewheels and cassettes

Control cables wear or breakage (shift cable)

Corrosion due to exposure to elements encountered during reasonable use

Paint and/or finish deterioration

Damage due to misuse and/or abuse, accidents, stunt riding, racing, or other unintended use

 Damage due to improper repair and/or maintenance and the installation of parts and/or accessories not approved for use by Civilized Cycles

Damage to the electrical system due to unauthorized modification and/or through the use of a battery pack, battery charger or other electrical components not provided by Civilized Cycles

Damage due to unauthorized modification of pre-programmed firmware, software and/or control parameters in the motor controller and/or suspension controller

Damage due to any adjustment, operation, service, or repair not specified in assembly, use, maintenance and service instructions provided by Civilized Cycles

Labor is not reimbursable under the Civilized Cycles Limited Warranty. 

The Civilized Cycles Limited Warranty extends from the date of purchase, and is offered only to the original purchaser and is not transferrable.

Battery pack:  

The Civilized Cycles battery pack is covered by a prorated warranty for a period of three years:

During the first year of service (based on the date of purchase), a defective battery pack will be repaired or replaced at no charge to the customer

During the second year of service, a defective battery pack will be replaced for 1/3rd the cost of a new replacement battery pack

During the third year of service, a defective battery pack will be repaired or replaced for 2/3rds the cost of a new replacement battery pack

This prorated battery warranty will be null and void under the following conditions:

The battery pack has been damaged due to physical misuse and/or abuse by accident, exposure to excessive moisture, extreme heat, cold or harmful chemicals 

The use of any battery charger not supplied by Civilized Cycles

Unauthorized opening or tampering of the battery case

Service not performed or authorized by Civilized Cycles

Modification of pre-programmed firmware, software and/or control parameters in the battery management system

Use of the battery pack for any application other than use in The Civ electric bicycle and to power a USB device via the integrated USB ports

NOTE:  Non-functional batteries can only be diagnosed by Civilized Cycles or by a designated battery repair shop. Batteries will be repaired or replaced on an exchange basis.

Modified versions of the Civilized Cycles Limited Warranty are available to designated commercial operators.  Please contact Civilized Cycles for details.

Shipping Policy

The shipping price and delivery time are calculated directly from Civilized Cycles. Select the products you want, click "checkout", and then include your data and zip code. Our website will automatically calculate the shipping cost.

SECTION 1 - SHIPPING CHARGE

Civilized Cycles includes a standard shipping charge for some regions of the continental United States (not including Hawaii or Alaska, these require an additional shipping surcharge). Please reach out to our team if you have any questions or would like additional information.

SECTION 2 - DELIVERY TIME

The delivery period for all purchases is estimated according to the production period or available stock, in the case of accessories, added to the carrier's term and may change. We are committed to doing our utmost within our powers to respect the commitments made to our customers.

SECTION 3 - DELIVERY ACCURACY RESPONSIBILITY

Civilized Cycles undertakes to deliver the product within the stipulated period, but for this, it is very important that the address is correct and complete, and this is the sole responsibility of the customer during checkout. SECTION 4 - RESPONSIBILITY FOR PAYMENT OF FREIGHT IN CASE OF EXCHANGE OR RETURN

In case of return of the product in accordance with our return policy, the shipping charges in addition to a restocking fee will be deducted from the returning item. The refund will be authorized upon receipt and inspection of the bike at Civilized Cycles’s warehouse. For a return, the customer must first contact us via telephone, chat or e-mail and request authorization. 

In case of an exchange of the product in accordance with our exchange policy, the shipping charges in addition to a restocking fee will be charged to the customer. Shipping charges will be waived in the case the customer lives within one of Civilized Cycles’s hub cities (see current list). For an exchange, the customer must contact us via telephone, chat or e-mail and request authorization.

Return / Exchange Policy

I received the product, but I want to exchange it.

If you purchased the product through civilizedcycles.com and you want to exchange what you have purchased: You have up to 30 calendar days after receipt of the product (based on your delivery date) to request the exchange. To be able to replace it, the product must be in the same condition as it was received, that is, in the original packaging, without signs of use or tampering, with the original seal or manufacturer's labels, invoice, manual and all accessories.

Contact us before returning the product. Many of our products are unique and exclusive pieces, there is the possibility that it will not be possible to exchange for the same product or that there are limitations in availability that might factor into your decision to return. The customer can exchange for another piece from the site of the same value, pay or receive the difference in case of different values ​​or choose to revert the amount paid.

I received the product, but it was damaged in transit.

If you receive the product with the box damaged, open or wet and this results in a product also damaged. Refuse receipt and immediately notify our support (information@CivilizedCycles.com). If damage is noticed only after delivery, our support must be notified within 48 hours of delivery to be able to work with the carrier.

After receiving the product, if you eventually notice any defect or defect when using it, immediately stop using it and contact us for analysis and, if necessary, measures will be taken in accordance with the rules contained in the warranty term.

Cancellation

You have the right to a full cancellation of your order at any time until a tracking number has been provided to you and the shipment has been received by the carrier.

In case of cancellation after the products have been received by the carrier, the necessary shipping charges in addition to a restocking fee will be deducted from the returning item.
